Terms of Service

1. Acceptance of Terms

By accessing or using Find My Partner ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Find My Partner, governed by the laws of Zimbabwe and applicable international laws.

2. Description of Service

Find My Partner is a relationship verification platform that uses facial recognition technology to identify whether an individual is registered by multiple users as their partner. The Service includes:

• Partner registration and photo upload
• Facial recognition and matching services
• Match notifications and alerts
• Paid access to match details and information

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. The Service is intended for personal, non-commercial use only.

4. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Not create multiple accounts or share account access

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Conduct and Responsibilities

You agree NOT to:

• Upload photos of individuals without their knowledge or appropriate legal authority
• Use the Service for harassment, stalking, or any unlawful purpose
• Upload false, misleading, or fraudulent information
• Attempt to circumvent security measures or access others' accounts
• Use automated systems or bots to access the Service
• Reverse engineer or attempt to extract facial recognition algorithms
• Use the Service to discriminate against any individual
• Violate any applicable Zimbabwe or international laws

6. User Responsibility for Uploaded Content

You are solely and exclusively responsible and liable for all images and content you upload to the Service. Find My Partner acts solely as a neutral technology platform and assumes no responsibility or liability whatsoever for user-uploaded content.

By uploading any image to our Service, you acknowledge and accept that:

• You bear full responsibility for all content you upload to the platform
• You must ensure that the relationship type you select accurately reflects your actual relationship with the individual depicted
• You assume full and complete legal liability for any claims, damages, losses, or legal actions arising from your uploaded content
• You will indemnify and hold harmless Find My Partner from any claims related to your uploaded images

Find My Partner expressly disclaims all liability relating to user-uploaded content. We do not:

• Verify the accuracy of relationship claims made by users
• Endorse, approve, or take responsibility for the accuracy or legality of uploaded content
• Accept liability for any unauthorized uploads, privacy violations, or misuse of images by users
• Guarantee the identity or intentions of users who upload images

7. Payments and Fees

The Service operates on a pay-per-action model:

• Partner Upload: $5.00 USD (one-time fee)
• View Match Image: $1.99 USD per match
• View Match Details: $1.99 USD per match
• Random Search: $5.00 USD per search
• Relationship Type Change: $2.50 USD per change

All payments are processed through Paynow and are non-refundable unless required by law. Prices may change with notice. You are responsible for all applicable taxes.

8. Refund Policy

Due to the nature of our digital services, all payments are final and non-refundable. Exceptions may be made at our sole discretion for technical failures that prevented service delivery. Refund requests must be submitted within 7 days of the transaction.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Find My Partner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• We are not responsible for any relationship outcomes, emotional distress, or personal decisions made based on information obtained through the Service
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for actions taken by other users of the Service

11. Indemnification

You agree to indemnify, defend, and hold harmless Find My Partner, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including privacy rights; (d) any content you upload to the Service.

12. Intellectual Property and Content Rights

Platform Intellectual Property: All content, features, and functionality of the Service, including but not limited to text, graphics, logos, algorithms, and software, are owned by Find My Partner and protected by Zimbabwe and international copyright, trademark, and other intellectual property laws.

User-Uploaded Content: You retain full ownership of all images and content you upload to the Service. Find My Partner does not claim any ownership rights over your uploaded content.

Limited License Grant: By uploading content, you grant Find My Partner a limited, non-exclusive, royalty-free license solely to:

• Store and display your uploaded images within the Service for the purpose of providing the matching functionality
• Process images through our facial recognition technology to generate mathematical embeddings for matching purposes
• Display limited information to other users who have paid to reveal match details

What We Do NOT Do With Your Images:

• We do not sell, license, or transfer your images to third parties
• We do not use your images for advertising, marketing, or promotional purposes
• We do not use your images to train artificial intelligence or machine learning models beyond the immediate matching service
• We do not retain your images after you delete them from the Service (subject to reasonable backup and deletion timelines)

This limited license terminates when you remove your content from the Service or delete your account.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved as follows:

• Informal Resolution: Contact us first to attempt informal resolution
• Mediation: If informal resolution fails, disputes shall be submitted to mediation
• Arbitration: Unresolved disputes shall be settled by binding arbitration in accordance with the Arbitration Act of Zimbabwe
• Governing Law: These Terms are governed by the laws of Zimbabwe
• Jurisdiction: Courts of Zimbabwe shall have exclusive jurisdiction

14. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may terminate or suspend your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

16. Compliance with Zimbabwe Law

The Service operates in compliance with applicable Zimbabwe laws, including:

• Cyber and Data Protection Act (2021)
• Electronic Transactions and Electronic Commerce Act
• Criminal Law (Codification and Reform) Act - provisions on harassment and privacy
• Consumer Protection Act

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Find My Partner regarding the Service and supersede all prior agreements and understandings.

19. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use after such notification constitutes acceptance of the modified Terms.
